• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-60-183 <br />INSPECTION DATE_June 1, 1999 INSPECTOR'S INITIALS TAS <br />OBSERVATIONS <br />1. A site inspection was made of the Brannan Sand & Gravel Pit No. 29 in order to determine <br />if there has been any significant reclamation work completed since the last ground inspection <br />by the Division on January 15, 1998. Mr. Fred Marvel of Brannan Sand & Gravel Co. was not <br />present during the inspection. <br />2. The site inspection confirmed that all disturbances noted on January 15, 1998 have not yet <br />been reclaimed and that additional disturbances have occurred in the Phase 3 & 4 areas. The <br />January 15, 1998 site inspection was the basis for the Division's calculated reclamation cost <br />of $413,400. As noted in the Division's January 15, 1998 inspection report, the existing <br />financial warranty of $89,435 is inadequate to assure reclamation of the existing <br />disturbance. The Division then made a request of the operator to submit either a replacement <br />warranty of S413,900 or a supplemental warranty of $323,965 by March 31, 1998. Other options <br />given to the operator to resolve the financial warranty concern included A) submit an <br />application for an amendment to the permit which may result in more cost effective mining & <br />reclamation and a lower reclamation cost, B) perform reclamation to lower the reclamation <br />liability to the level of the current financial warranty, ie: $89,435, or C) perform some <br />combination of A & B. <br />3. To date, the financial warranty for Brannan Pit No. 29 remains at $89,935 and none of the <br />options listed in item 2 above have been completed. Therefore, the financial warranty for <br />the site remains inadequate and Permit No. M-80-183 is not in compliance with Rule 4.2.1(1). <br />Rule 4.2.1(1) requires that all financial warranties shall be set and maintained at a level <br />which reflects the actual current cost of fulfilling the requirements of the reclamation <br />plan; fulfilling the applicable requirements of the reclamation plan. <br />9. Subsequent discussions with Mr. Marvel indicate that Brannan Sand & Gravel Co. is willing <br />and able to submit either a replacement warranty of $413,400 or a supplemental warranty of <br />$323,965 by no later than June 18, 1999.
