III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by DRMS staff from the Durango Office, <br />701 Camino del Rio, Room 125, Durango, CO 81301, (970) 247-5469. The permit was revoked in a <br />previous decade; financial warranty was forfeited and utilized for final reclamation. <br />No activities were observed; no individuals were contacted during the inspection. Cable gate was not <br />locked at the mine entrance. Industrial debris, previously imported by the landowner, has been <br />stockpiled on site. Newly imported and stockpiled materials include various pieces of culverts and an <br />elevated fuel storage tank. <br />Sediment pond was holding water, approximately 1 foot deep. Primary and secondary spillways for <br />the pond had previously been removed by landowner activities. <br />Water was not flowing in the Coal Gulch stream channel. The landowner has reconfigured the <br />alignment of the channel to report directly to a large, approximate 48" diameter, concrete culvert for <br />Hwy 160. The realignment of the channel has resulted in sediment being delivered to the inlet of the <br />culvert, Sediment deposition at the culvert inlet appeared to have obstructed approximately 40% of <br />the culvert's capacity. <br />
