III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions Taken during the inspection and The facts of evidence supporting the enforcement action. <br />Carry-over items of concern from previous inspections: None. <br />This aerial inspection report is prepared by Byron G. Walker from 8 aerial photographs (numbers 19- <br />02-09-26-79 p9) through 19-02-09-26-86 (86), and an oral debriefing of, Mr. Harry Ranney, <br />Environmental Protection Specialist of the Division. The pictures are on file at the Division and <br />copies of the aerial photographs have been provided to Colowyo Coal Company, L.P. by e-mail. <br />The pictures were taken on September 26, 2002 by, Mr. Ranney. Mr. Ranney stated (October 1, <br />2002) that he saw no problems at the site. <br />No aspect of the mining and reclamation activities appear to be out of compliance with the Rules <br />or the Permit. <br />HYDROLOGIC BALANCE Surface water appears in the Section 16 Pond (picture 79), East Taylor <br />Pond (picture 81, Work Area Pond (pictures 82and 84), West Pit Pond (picture 82}, Washbay Area <br />Pond (picture 84), Sediment Sump (picture 84), Aeration Pond (picture 84), Streeter Pond (picture <br />85), and Gulch A Pond (pictures 85 and 86). There appeared to be little if any water in the <br />Evaporation Ponds (picture 84). Portions of sediment control ditches are portrayed in pictures 79, <br />82, 85, and 86. The permanent reconstructed West Pit Ditch is portrayed on picture 82. No <br />deficiency appears at any of these structures <br />SUPPORT FACILITIES The shops, field office, storage areas, tanks, explosives storage area appear in <br />picture 84, and the parking apron in picture 83. All of these facilities appear to be in compliance <br />with the Rules and the Permit. <br />GENERAL MINE PLAN COMPLIANCE Placement of backfill on the floor of the north-south Section 16 <br />Pit floor can be seen on picture 79. Clearing, grubbing and removal of topsoil has taken place in <br />advance of the West Pit (picture 80). All three pits, (East, West and Section 16 are portrayed on <br />picture 80. Extraction of coal, backcasting, and transport of spoil by truck appears to be <br />underway in the West and East Pits. There does not appear to be any activity in the Section 16 Pit. <br />These operations appear to be in compliance with the Rules and the Permit. <br />EXCESS SPOIL & DEVELOPMENT WASTE The West Pit Fill appears in picture 82, and the Streeter Fill in <br />picture 85.
