The operator <br />has submitted an application to convert the existing 110 operation to a 112 Regular permit. The operator <br />proposes to expand the existing permit to incorporate moss of the county lands in section 30, 14 south, 78 west <br />(the county owns 40 acres). The applicant does not intend to Include those lands containing septic sludge <br />deposits. <br />The existing 8-acre permit has not been mined for some time. Re-vegetation efforts have been quite successful <br />in most of the disturbed pit. The permiHee imported several loads of eroded soils and dumped the material in <br />the southern portion of the permit area. Pursuant to Rule 3.1.5(9), the operator must submit a notice to the DMG <br />in compliance with this Rule. <br />There are two major man-made structures that traverse the proposed expanded acreage. A large power line <br />and an underground gas line are structures that need to be addressed pursuant to requirements of Rule 6.4.19. <br />The applicant must provide documentation to the DMG, as required in Rute 6.4.19, that the structure owners are <br />satisfied with the required agreements, or provide an engineering study that will demonstrate to the DMG's <br />satisfaction that the structures will not be adversely affected by the proposed mining operation. <br />The Division received four (4) letters of Concern (tfiree of which moy became objections). Most of the concerns <br />are not under the DMG's jurisdiction. One concern involves septic sludge deposits. According to the concerned <br />citizens, and confirmed by the county, part of the county land was used, at one time, as a septic sludge <br />depository. Mr. Joe Nelson, county representative, said the lands tfiat contoin septic sludge will not be mined <br />and are not included in the proposed expanded permit area. <br />If the concerned citizens (that submitted timely concern letters) decide that they want to object to the <br />conversion application the DMG will initiate the appropriate hearing process (pre-hearing conference, etc). <br />Mr. Joe Nelson indicated that the application will be slightly modified to increase the total acreage of the <br />proposed 112 permit area. He said the size of the permit should have increased by 20+ acres, not increased to <br />20 acres.
