III. Comments - Comnliance
Below are particular issues with regard to any of the compliance items.
Enforcement actions resulting from failure to comply with the Act, Rules
and Regulations, and the permit also are identified below.
1. Mr. Mitchell indicated that mine inflows have increased a small
amount over the past few weeks. Some of this water is now pumped to the
lower sedimentation pond. Monitoring of both mine inflows and pond
discharges has occurred. This data should be sent to the Division as
soon as it is available. This information may shed some light as to the
source of the inflows.
2. The access road drainage ditch appeared obstructed by sediment
and rocks in several places. The operator was instructed to reestablish
the drainage ditch promptly. Upon returning to the mine the following
day, all maintenance concerns were found to be corrected.
3. Urainage from a portion of the portal bench was diverted over
the pad outslope instead of through the approved culvert. The operator
was advised that this needed to be corrected, since this water might
induce sloughing. This item was corrected upon my return on 3/30/83.
