~~ ~ ~ <br />OBSERVATIONS <br />This inspection was conducted by Tony Waldron of DMG along with Jane Flanders of Canyon Dolomite Quarry as a result <br />of a complaint received at the Division on 4/13/99. The site is located just west of Canon City, Colorado. <br />The complaint alleged that the operator was planning to improperly dispose of a po[enitally hazardous material by <br />burning the substance on site ra char than disposing of it at a facility approved to accept waste of this nature. <br />The waste is a tank sludge which leaked out of a large storage tank onto the ground. This material was then <br />collected into 3 containers and stored on the lower level of the mine site. The material appears [o be solidified <br />diesel or gasoline and does not appear to contain Eree liquids. <br />in February, the site was inspected and two possible violations were cited. one involved signs and markers and the <br />other one involved the clean-up of the afore mentioned material. On March 23, 1999, a follow-up inspection was <br />conducted to determine if the PV's had been corrected so that they could be withdrawn from Ghe Board. It was <br />detemmined [hat the signs and markers problem had been corrected and that [he leaked substance had been picked up <br />and stored in one 50 gallon metal drum and two 30 gallon plastic drums on the lower level of the mine site. The <br />operator did ask about the possibility of buying the material but it was discouraged and they were informed that <br />the material should be disposed of in an approved facility with evidence of such disposal submitted to the Division. <br />Since the immediate threat of po[enial surface water contamination had been alleviated, the items were withdrawn <br />from the Hoard agenda. <br />During this inspection, it was observed that the material was still stored in the drums on the lower level. The <br />operator and [he DMG inspector contacted a local private landfill with a sample of the material to see if they would <br />accept it. The landfill indicated that as long as there were no free liquids in the material it could be disposed <br />of at their facility and they would issue a receipt of acceptance. A copy of this receipt moat be submitted to <br />the Division upon removal of the material. <br />Based on this inspection, the material is still being stored in containers at the mine site. As long as the <br />operator submits proof of proper disposal of the material, this problem will be resolved.
