III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />Bear Coal Company during the records check but no one represented the operator during the field inspection. <br />There had been a precipitation event during the weekend so the area was wet. <br />Facilities <br />The operator has gutted the mine office building. Three days after the formal field inspection, the operator began <br />demolishing the mine office building. The debris will be burned and buried on site. The front gate to the mine <br />site was open. The chain and lock on the gate need to be replaced to limit access to the mine site. The "no <br />trespassing" sign was up on the gate. <br />Hvdroloev <br />There was a small pool of water in the sediment pond. The gate on the primary discharge tube was closed. The <br />emergency spillway was functional. The collection ditch had sufficient capacity. The hillside spring water <br />treatment pond was discharging at about 15 to 20 gpm. The discharge was the usual orange color, which has <br />been found to be in compliance. The riverside protection berm had sufficient height. There were no problems <br />with alluvial wells AA-1 and AA-3. Well caps were on. The hillside spring was flowing in its channel. The <br />temperature of the spring water was 98 degrees Fahrenheit at a point about 8 feet below the origination point. <br />Roads <br />The paved haul road was in good condition. The bridge across the river was passable. <br />Siens and Markers <br />The mine [D sign at the top of the hill needs to be put back onto its post. Surface disturbance mazkers were up <br />around the surface disturbance area. <br />Reclamation <br />The east side reclaimed hillside appeared to be stable, with a good vegetative stand. The west side did not <br />appear to be stable, however. The earlier instability at the reclaimed west portal area appears to have ceased <br />since cracks and depressions have naturally filled in. However, new cracks in the west portal area backfill have <br />appearedjust to the east. <br />Records <br />All of the required mine records were located at the Bowie No. 2 mine office, as documented on the attached <br />records checklist. <br />c:/word/bear3/i nsp 1007 <br />
