III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG). This mine has closed and reclamation of most areas is <br />complete. Ground conditions were dry and the weather was hot and dry but thunderstorms <br />were looming in the distance. <br />Availability of Records <br />The mine records are kept at the EFCI office in Florence, 719-784-6395. All records were <br />found current and in compliance. Details of the records check can be found on page 2a of <br />this report. The 2004 Annual Reclamation Report for the Raton Creek Mine, #C-82-055 was <br />given to the inspector for hand delivery to the Division. Aforth-coming draft of a bond <br />release application for the Raton Creek Mine was also provided and reviewed during the <br />office visit. <br />Roads <br />The mine access road was dry. Water bars have been regraded to improve vehicle crossing <br />and reduce roughness. At this time, the regrading has improved the crossing of the water <br />bars and reduced roughness. <br />Hvdrolooic Balance <br />Sediment ponds 4 and 5 were both observed dry. Embankments, and spillways appeared <br />normal and in good condition. The Magpie Creek diversion did not show any sign of recent <br />heavy flows. <br />Processing Waste <br />The refuse pile appeared in good condition with no sign of slumps or damage of any kind <br />All drainage control appeared normal and in functional condition. <br />Reveoetation <br />Vegetation is enjoying a banner year of growth after abundant spring moisture. Yellow sweet <br />clover is flowering on the reclaimed area as well as in surrounding undisturbed areas. <br />Annual weeds are present but less abundant than last year. Cool season grasses are <br />reproducing but warm season grasses have yet to begin to flower. Cattle were not observed <br />on the reclaimed area but were noted in next to Chen's HiN in the GEC permit area. <br />
