The <br />site is a small 112 sand and gravel operation located approximately 10 miles North of Cripple Creek <br />Colorado. The operator contacted the Division and wanted an on site meeting to discuss a possible mining <br />plan change. <br />According to the operator's agreement with the Forest Service, who owns the mineral rights, the operator is <br />only allowed to mine 100,000 tons of aggregate/ year. Since the DMG permit does not have such <br />stipulations, the operator wanted to know what, the best way was, to expand the mining limitation, with <br />out being in violation with the Forest service. Since the 100, 000 tons/ year limitation was to the existing <br />112 permit, the only option for the operator was to obtain another permit, possibly a 110, next to the <br />existing 112. This will allow them to double the production. Another option discussed was, if the Forest <br />service will allow them to average yearly production for five years, it might eliminate the need for a new <br />permit. By the operator's own admissions, the average production for the site is normally about 30,000 <br />tons/ year. However, this year, they have a contract with the county, that will require them to mine <br />200,000 tons. The warranty posted by the operator for the 112 permit covers the entire affected acreage <br />so there would not be a problem with the DMG permit if the production were increased. <br />Mr. Greg Loop, who was present during the inspection agreed to contact the Forest service and let the <br />Division know what options they will implement. <br />The site was active at the time of the inspection.
