III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken durng the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This site consists of two separate reclaimed areas; a coal <br />loadoutltipple area and a portal area. separated by a rocky ridgeline. Ground conditions on <br />this day were snow-covered and muddy. The weather was windy and mild. <br />,,, <br />~drologic Balance <br />A single sediment pond also remains at the upper bench near the former mine portal The <br />pond was found dry. A stockpile of material remains next to this pond to be used as fill if the <br />pond is reclaimed in the future Ditches and berms on the bench were observed in good <br />condition with no breaches or damage noted No runoff was observed from the limited <br />snowmelt occurring on this day. <br />One, small sediment pond remains at the loadout/tipple area. A small amount of frozen <br />water was present in the bottom of this pond. <br />
