(Page 2) MINE ID # OR PROSPECTING ID #: nt-2nn2-n52 INSPECTION DATE: Ofi/vv/n3 INSPECTOR=S INITIALS: TGS OBSERVATIONS 1. An aerial inspection of Two Rivers Rock was conducted. Several or more oblique photographs of the 48.5 acre site were taken with a digital camera and will be used by the Division staff during future permitting and/or ground inspections to determine compliance with the approved mine and reclamation plan. The photographs are attached to this report and will be made available to the operator upon request. 2. The status of the Two Rivers Rock is "awaiting warranty". Therefore, a mining and reclamation permit must first be issued by the Division prior to disturbance. The aerial photographs verify that there is no mining disturbance at the site. The operator is also advised to check with the local county government to determine their permitting requirements prior to disturbance. The operator has until August 21, 2003 to submit acceptable performance and financial warranties for permit issuance. If the warranties are not received by this date the applicant will be required to request a hearing before the Colorado Mine Land Reclamation Board for reconsideration of the previous approval per Rule 4.1(2). The applicant will also be required to republish, re-notice adjacent landowners, and address any new permanent man-made structures within 200 feet of the affected land. The Division approved Western Equipment & Truck Inc.'s application for a Regular 112 Permit on August 21, 2002 and set the required amount of financial warranty at $431,404. Please see attached Division correspondence dated August 26, 2002 and May 21, 2003 requesting the required warranties.
