III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting The enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear <br />represented the operator. There had been a few inches of snow two nights before. <br />Roads <br />The paved haul road was a little icy but was passable and in good condition. The guazdrail was <br />installed..The haul road leading to the gob pile was snow packed but also was passable and in <br />good condition. The haul road berm was functional. <br />Hydrology <br />Pond B was snow covered but the snow/water level was up to the primary discharge structure. <br />Pond C was also snow covered. The level of the snow/water in Pond C was up to the primary <br />dischazge pipe. The snow level in Pond D was below the primary dischazge structure. All pond <br />embankments appeared to be stable. Pond inslopes were stable and discharge structures appeazed <br />to be functional. <br />Gob Pile <br />There was a fair amount of snow on top of the gob pile, although it was melting. There was <br />positive drainage on top of the pile. Most of the gob material on top of the gob pile has been <br />graded out and compacted, with only a few small piles of ungraded waste remaining. The gob <br />pile haul road berm at the entrance to the gob pile was functional, as was the road culvert. <br />Facilities <br />There was a large amount of coal that was stockpiled on the lower coal stockpile bench. Coal <br />haul trucks were being loaded at the time of the inspection but no evidence of fugitive dust <br />problems was observed. There was a small amount of coal that was stockpiled on the portal <br />bench. <br />No problems were observed with the facilities on the portal bench. A contractor was using a <br />backhoe to dig a phone cable trench neaz the mine entrance. <br />Cut and Fill Slones <br />There was no evidence of any cut and fill slope geotechnical instability at the mine site. <br />c:\ms97\bowie2\insp0102 <br />
