Page 40 <br />Hard Rock/Metal Mining Rule 1 <br />1.13.9 Ten Year Limitation for Temporary Cessation <br />In no case shall Temporary Cessation be continued for more than ten (10) yeazs <br />without terminating the mining operation and fully complying with the Reclamation <br />and Envirotunental Protection Plan requirements of the Act and these Rules. <br />1.14 TERMINATION <br />1.14.1 Permit Termination <br />103(6)(a)(IV) (1) Apermit granted pursuant to these Rules shaIl continue in effect as long <br />as: <br />(a) the Board does not take action to declare termination of the <br />life of the mine, which action shall require a sixty (60) day notice to the <br />Operator alleging a violation of the permit, the Act or Rules; or <br />(b) there is a discontinuance of the mining operation with a <br />Temporary Cessation filing as provided in 1.13.5 or 1.13.7; or <br />(c) there is no failure to submit the reports required under <br />Subsection 1.13.5 and 1.13.7; or <br />(d) there is no fadure to comply with the requirements of Rule <br />1.13.8. <br />(2) In the event the Operator is not incompliance with the provisions of <br />Subpazagraph 1.14.1(1), the Boazd shall provide a reasonable opportunity for the <br />Operator to meet with the Boazd to present the full case and further provide <br />reasonable time for the Operator to bring violations into compliance. Such hearings <br />and procedures shall be in compliance with the requirements of Subsection 3.3.2; or <br />at such hearings the Boazd may: <br />(a) declare termination of the life of the mine according to the <br />provisions of this Rule and after finding a violation in accordance with <br />Subsection 3.3.2; or <br />(b) declare that a mining operation is in a state of Temporary <br />Cessation, establishing a commencement date, as necessary, according to a <br />review of the facts. <br />
