A site inspection of the Phoenix Mine was made as part of the Division's on-going 4-year inspection program. The <br />Phoenix Mine is located approximatelyl.8 miles northwest of Idaho Springs and 0.75 miles up Trail Creek Road. Present <br />during the inspection was Mr. Alvin Mosch. <br />2. The Phoenix Mine is permitted for a total of 0.44 acres. The Phoenix Mine is apre-existing mine that had considereble <br />production during the period of 1935 to 1942. The mine plan specifies that all waste rock from the new workings will be <br />stored permanently in old underground stopes and serve as ground support. The waste products from the ore dressing <br />(surface) facility will be returned to the mine and stored in the old stopes. Extraction will begin from pre-existing <br />underground workings. New surface disturbances will be confined to the area used for the ore dressing facility and a <br />settling pond placed on the existing mine dump. The post-mining land use specified is recreation. The mine will be <br />reclaimed to a mountain cabin site and/or tourist mine. The operator has posted a financial warranty in the amount of <br />$200. The Division finds the existing financial warranty to be adequate to complete any remaining reclamation tasks. <br />3 . There have been no significant changes at the Phoenix Mine since the last Division inspection on April 18, 2000. <br />However, the three (3) barrels of unidentified material on the bench above the mine building, as noted in the previous <br />inspection report, have been removed. Acrnrding to the annual reports filed by the operator, the only underground <br />activity that has occurred at the Phoenix Mine since permit issuance occurred in 1983 when waste from drifting was used <br />to fill open stopes in the underground workings of the mine. All other reported activities have been surface activities <br />related to drainage control and/or re-vegetation. Also, it appears that the last recorded reclamation activity at the mine <br />occurred in 1998 when minor re-vegetation tasks were completed. The site inspection confirmed that there is no current <br />underground or surface activity involving ore extraction, ore dressing, or backfilling of old underground stopes with waste <br />rock. The mine is now being used, very successfully, as a tourist mine. Also, the operator has done an excellent job of <br />making the mine available for training and educational purposes. <br />4. Based on review of the annual reports and observations made during the inspection, it appears that the operation may <br />be inactive. However, the operator has not submitted a notice of temporary cessation. In order to clarify the status of <br />the Phoenix Mine, the Division requests that the operator review the attached criteria for temporary cessation (Rule <br />1.13.2) and indications against temporary cessation (Rule 1.13.3), and respond within 30 days of the intent/status of the <br />operator for the Phoenix Mine. In the event that extraction of minerals has been completed and only final reclamation <br />and related activities remain, the operator may consider submitting a written request for complete financial warrant <br />release, in accordance with the requirements of Rule 4.16.1 (see attached copy). The Division considers the status of the <br />Phoenix Mine to be a problem that will require corrective actions. Please see page 3 for corrective actions. <br />5.
