<br /> <br />N. Status of Problem Resolution <br />The following items concern problems identified at previous inspection. Problems are classified <br />into three categories. These are: (Z) problems resolved; (2) resolution still in process; and <br />(3J operator delinquent. The date that the problem is resolved or the date that the operator <br />is deemed delinquent is to be clearly stated. <br />All of the problems cited by Jim Herron in his inspection of January 14, 1981, have been <br />addressed. <br />1. The section of the east undisturbed drainage ditch has been cleaned out as requested. <br />However, additional slumpage has occurred and is noted in Section II and III of this <br />report. <br />2. ravel fill has been completed around refuse area piezometers as specified. <br />3. The refuse site was compelted and graded so that drainage is directed to the ditch <br />along the outside of the area and the access road, thus eliminating the need for the <br />ditch that was buried. <br />4. The section of the west ditch running into the sediment pond below the culvert has <br />been widened and riprapped with 1-3 inch loose rock. This appears to have stabilized <br />the channel and eliminated down cutting that was resulting from minewater flows dis- <br />charged through the culvert. <br />5. The section of the east ditch running into the pond north of the culvert has been <br />deepened and cleared of organic material with the exception of several persistent <br />juniper snags. <br />6. A culvert has been installed as specified where drainage ditch crosses by trash dump <br />area. <br />7. The ditch below the diesel tank has been cleaned as requested. <br />8. Diversion ditch has been extended across the road near the office trailer. <br />Notices of Violation 81-1 and 81-2 were issued by Jim Herron following his January 14, <br />1981, inspection on problems 3,4, and 8. These violations have been abated and Notices <br />of Proposed Amount of Civil Penalty have been issued. As assessment conference is <br />scheduled for March 23, 1981. <br />
