(Page 2) <br />MINE ID # OR PROSPECTING ID #: Ad-i9~9-1xs <br />INSPECTION DATE: i~ ina vz, ~nnx INSPECTOR=S INITIALS: ~_ <br />OBSERVATIONS <br />This was a normal monitoring inspection conducted by Tony Waldron and Chris Rowe of DMG along with Ben <br />Frei, AI Frei Jr. and Steve O'Brian of AI Frei and Sons. The site is 14 .2 acres in size and is located southwest of the <br />intersection of I-76 and Colorado Blvd. in Commerce City. The site is being used primarily as a staging area for <br />concrete and asphalt botching and a product stockpile area for material from the Clear Creek Quarry. <br />There was not a mine identification sign posted at the mine entrance as required by Rule 3.1.12j 1). This will be <br />cited as a problem on page three of this report along with corrective actions. The majority of the site was <br />mined some time ago and has been backfilled to a point that is well above The groundwater level. These <br />areas are now used as product stockpile areas and aconcrete/asphalt batch plant area. Some concrete <br />recycling activities also occur on this site and the adjacent Pit # 5. Basically the site is now used more as a <br />staging area rather than a mine site. However, it was conveyed to the inspector that the office area was <br />slated for mining. This area is approximately 2-3 acres and sits just south of the concrete batch plant area. <br />Unfortunately, this area was never incorporated into the permit area and in order for mining to occur here the <br />permit would need to be amended to add this parcel. <br />The original post-mining land use for this area was not clearly defined during the initial permitting, partially due <br />to the fact that the application did not contain specific categories of land use, and partially due to uncertainty <br />with respect to the final use. The post-mining land use did state that one of the possible uses was to backfill the <br />area to create a building site for future commercial development. However, this was never fully developed <br />and the county zoning for this location was not included with the application. The operator indicated that <br />commercial/ industrial zoning is now in place and they plan to reclaim the site to meet that use. Since this use <br />was never fully fleshed out in the original application, a technical revision will need to be submitted to <br />incorporate the final planned use which seems to vary from the original approved reclamation plan. This <br />revision should include a revised post-mining topography map and provide evidence of the approved zoning <br />form Adams County. In addition, full revegetation may not be desirable since the site could remain a batch <br />plant/recycling/stockpiling area for some time. If this is the case, the reclamation plan could be modified to <br />incorporate this change and allow the site to remain much as it currently exists. Once this technical revision is <br />approved and the changes have been incorporated into the application, the site may be eligible for release <br />provided that all mining has been completed. Since the approved application is unclear with respect to the <br />final land use, this will be cited as a problem on page 3 of this report with corrective action being the submittal <br />of the aforementioned technical revision. <br />This concluded the inspection. <br />18.
