III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete coal inspection and final Phase III bond release inspection of the North Eastside <br />Mine, conducted by Jason Musick of the Colorado Division of, Reclamation, Mining, and Safety <br />(Division) on 24 October 2007. Steve Self of Eastside Coal Company, Dan Hernandez of the Division, <br />and Warren Roberts the landowner of the mine site accompanied the inspection. The weather was <br />clear and sunny during the inspection. The ground was dry. <br />Availability of Records <br />Records were checked at the Garfield County Courthouse (see attached checklist). All required <br />records were on file with the exception of an updated copy of the Insurance Certificate and a copy of <br />the 2006 Annual Reclamation Report. These documents should be inserted to the permit records. <br />Signs and Markers <br />The mine I.D. signs were in place at the entrance to the mine site on Harvey Gap Road. Permit <br />boundary signs and stream buffer signs were in place. All signs and markers should be removed <br />when a final decision has been made as to the Phase III Bond Release. <br />Hydrologic Balance <br />The sediment pond was reclaimed several years ago. This area shows well covered vegetation with <br />no weeds evident. The two rock down-drains into the creek from the site are permanent and in good <br />condition. <br />Backfill and aradin <br />The backfilled slope in the former portal area appeared stable with no signs of erosion. There was <br />good vegetation cover throughout the area. <br />Reveaetation <br />The mine site has good vegetative cover throughout with diverse cover of grasses, fortis, and woody <br />shrubs. Minimal evidence of weed growth was found with no weed problems existing. The amount of <br />vegetative cover appears adequate to control erosion. <br />Reclamation Success <br />Reclamation obligations appear to be completed at the time of this inspection. All phases of <br />reclamation appear to be in compliance with requirements for Phase III Bond Release. The Division is <br />reviewing the vegetation data to determine whether to approve the request for final phase III bond <br />release. <br />
