III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of CDMG. Karl Koehler and Billy <br />Nicholson represented the operator <br />The ground was drying out from recent rain and snow showers. Vegetation is starting to <br />green up. <br />AVAILABILITY OF RECORDS <br />The records checklist is attached. All required records were available. The required <br />records were also on file at the Moffat County Courthouse (the 1999 blasting notice and the <br />only permitting action currently in review,TR-78). Also at the Courthouse was Trapper's <br />Phase I/II Bond Release Application which CDMG approved in 1998. <br />SIGNS AND MARKERS <br />The following types of signs and markers were properly displayed with the correct <br />information: mine i.d. signs. blasting warning signs, permit boundary markers, and topsoil <br />markers. <br />ROADS <br />The surfaces of haul roads, access roads, and light duty roads were in good condition, with <br />one exception: the light-duty road leading down to Oak Creek #1 pond has new 1-ft. deep <br />gullies. Runoff in this drainage needs to be redirected into the channel next to the road. <br />The light-duty road Leading to Ute pond is in good condition. This road was regraded last <br />fall following an extended period of gullying problems. <br />Haul road embankments and cut-slopes showed minimal erosion. Ditches next to roads <br />appeared to have design capacity. <br />HYDROLOGIC BALANCE <br />Ditches - The perimeter ditch on the west end of Trapper has design capacity. The <br />collection ditches in the Buzzard drainage and the West Flume diversion ditches are in good <br />condition and have design capacity. The perimeter ditch in Deer Gulch is partially filled <br />with sediment at its intersection with a temporary diversion ditch that Trapper put <br />downslope from a topsoil laydown area southwest of the open cut in D-pit. Although the <br />perimeter ditch is capable of functioning, any further sediment accumulation would require <br />Cleaning out. <br />Culverts - Culverts inspected were clear and not eroded. <br />Ponds- Ponds were discharging in the actively mined drainages (NO Name. Johnson. East <br />Pyeatt. and Oak) and in Ute. The sources of inflows into the ponds in the actively mined <br />drainages presumably was snowmelt and springs because none of the pits were being pumped. <br />Page 3 <br />
