<br />This was a partial performance warranty release inspection conducted by Tony Waldron of DMG <br />along with Mark Chalmbers of Robinson Brick Company. The site is located approximately 7.5 <br />miles northeast of Kiowa, Colorado. The mining area consists of five phases located in <br />three different locations. Phases I, 22 and V are located on and around an orphan knoll that <br />has been mined for gravel as well as clay. Phases III and IV are located in relatively <br />level areas on the eastern side of a prominent ridge in the area. The only active mining is <br />currently occurring in phase III, although no mining was taking place during this inspection. <br />Phase IV and V have not been disturbed and phases I, II have been mined out and reclaimed. <br />This request is for phases I and II only and the operator is not requesting a decrease in the <br />overall financial warranty. <br />The operator was encouraged to pursue a partial performance and financial warranty release <br />on phases I and II since the surface owner of the property has begun development on the top <br />of the knoll with the construction of a domestic dwelling. Although the remaining reclaimed <br />area is still unaffected, this could obviously impact the designated post-mining land use of <br />rangeland if additional dwellings are constructed. Therefore, based on a previous <br />inspection, it was suggested that a release should be pursued on this area before any <br />additional changes occur. <br />Reclamation of the site was conducted in 1991 and 1994/95. Vegetative establishment was very <br />good in some places and somewhat sporadic in others, however, this is probably to be expected <br />since the pre-existing vegetative cover was probably very spotty and it does not appear that <br />there was an abundance of topsoil available for reclamation. In addition, the vegetative <br />cover should continue to increase and spread as long as the site is not overgrazed or <br />otherwise mis-managed The regraded slopes appeared to be level enough so as to prevent <br />excessive erosion and very little erosion was evident over the majority of the reclaimed <br />area. Based on this inspection, phases I and II only could be fully released from their <br />perfoi~nance and financial warranty obligations. Phases III, IV and V will remain under full <br />financial and performance warranty obligation. <br />The current financial warranty is $30,900.00 which is adequate to reclaim the current <br />disturbance in area III. Since the operator is not requesting a financial warranty reduction <br />to accompany this performance release, the financial warranty will remain at $30,900.00, <br />although none of this will any longer be associated with areas 2 and II. <br />This concluded the inspection. <br />Contact Addres <br />NAME Mark S.
