~ III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />alteration of the terms or requirements of a permit issued under the Rules and the <br />Act, including, but not limited to, significant changes in the reclamation plan, and <br />other actions which the Board may by regulation prescribe. <br />The permitting process allows the Division and the Office of Surface Mining to <br />review the application for compliance with other pertormance standards other <br />than the single pertormance standard cited the NOV. Also, without proper review, <br />it is possible that implementation of the abatement may cause more harm to the <br />environment, have adverse hydrologic consequences and jeopardize the health <br />and safety of the public. <br />After the OSM inspector left a complete inspection commenced. Records were <br />check and all were found to be in order. <br />Ditches along the main access road to the mine were clear and functioning. <br />Culverts under the access road to ponds D and E were clear. All ponds still <br />contained some water even though the summer has been very dry. <br />The fuel storage area was clear of spills and the containment pond was empty. <br />The ditches around the east side of the facility's area were clear and uneroded. <br />The drop structure off the east side of the facility's bench was functioning <br />properly. Pond C contained some water and the embankments were stable. No <br />problems were noted in these two areas. <br />Topsoil is almost completed in the 720 area. Geochemical analysis of the <br />backfilled 720 area has identified the 5 acre plot in the southwest portion of the <br />720 area as having a high SAR value of 24.8. This level would be potentially <br />toxic to plant and would hinder successful revegetation. Only 6 inches of topsoil <br />are available for redistribution. The mine had placed 4 foot of cover over this <br />area of material that had been tested and met the Wyoming DEO suitability <br />criteria for SAR. <br />The sign at the loadout is faded from weathering and will need replacing. <br />
