If the culvert will remain in place past November 15, 2001, the <br />approval must be renewed. It is Henderson's responsibility to rert~ove the culvert <br />and restore the canal prior to November 15, 2001 or to request a renewal of the <br />culvert installation in the diversion canal Environmental Protection Facility. <br />Topsoil salvage and management for the area below the ultimate taili~ag elevation was <br />observed and discussed. Alternatives to stripping and stoc}:piling topsoil <br />immediately following clearing and grubbing operations were considered. The Division <br />agrees with and approved topsoil handling practices in this area thzit could include <br />leaving the topsoil in place temporarily and seeding or otherwise stabilizing in <br />place topsoil as needed following logging. Acceptable topsoil manag~=_ment could also <br />include pushing the topsoil resource up the hill to an elevation above the ultimate <br />tailing surface and windrowing that material for consolidation into stockpiles at <br />a later time. If this practice in used, the windrows would have to be seeded and <br />other management practices such as silt fencing or toe ditching may be necessary. <br />Under any topsoil management scenario, the reclamation permit requires that all <br />viable topsoil be salvaged from the tailing basin in advance of tai:.ing inundation. <br />There are currently two topsoil stockpiles located below the ultimate tailing surface <br />elevation. These stockpiles must be moved prior to inundation. Rule 3.1.9(4) of <br />the Hard Rock/Metal Mining Regulations requires that a topsoil stoc}~ile relocation <br />plan be approved under a technical revision to the reclamation permit. Henderson <br />is referred to a letter from the Division of Minerals and Geology (Allen Sorenson) <br />to Climax Molybdenum Company (Anne Beierle) dated December 17, 1998. This letter <br />provides a discussion of the Division's position on topsoil salvage requirements in <br />the Henderson Mill tailing basin.
