III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This was a complete, OSM oversight inspection conducted by Kent Gorham of <br />the Colorado Division ofi Minerals and Geology. Mitch Rollings of the <br />Office of Surface Mining (OSM) was also present. This former underground <br />site is entirely reclaimed. Ground conditions on this day were dry and <br />the weather was hot and breezy. Mr A.J. Iuppa, the landowner at the site, <br />opened the gate allowing access to the area and was present during the <br />inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the shop building on the <br />site. The first quarter sediment pond inspection and first quarter <br />refuse pile inspection could not be located. The operator should <br />maintain a complete set of records through the last full calendar quarter <br />at the public site. All other records were found as detailed on the <br />attached checklist. <br />Hydrologic Balance <br />The sediment pond at the site had a small amount of water in it. <br />Cattails are abundant in the pond. The ditch system directing disturbed <br />area runoff appeared functional with no apparent breaches or problem <br />sections. The former location of the topsoil pile is a Small Area <br />Exemption (SAE). It is heavily vegetated and appeared stable. <br />Processing Waste <br />The non-topsoiled portion of the refuse slope has been interseeded and <br />long stem hay has been crimped into the slope to provide additional <br />erosion protection. No sprouting of the interseeded species was noted, <br />likely due to prevailing dry consitions. Some Cicer milkvetch was noted <br />on the slope from pre-existing revegetation. Rabbitbrush and Sage were <br />noted on the refuse pile. The 100-year ditch above the refuse disposal <br />area was traversed along its entire length and appeared in good <br />condition. The sloughage from above the ditch directly behind the shop <br />building had been cleaned from the ditch. <br />Reveoetation <br />Vegetation at the site can qualitatively be rated as fair to good on most <br />areas excluding the interseeded area of the refuse highwall.
