MOTARfK DALE TOOL[r <br />TMOMAB M, BTERN 11099 •IDSS) <br />Re: Colina Oro Molino, Inc., Gold Hill Mill; Permit No. M-94-117; <br />Notice of Violation No. M-95-078, Continuance of Rearing to Consider <br />Civil Penalty Set for January 15, 1996 (Agenda Item 38) <br />Dear Members of the Board: <br />I have discussed several matters which maybe considered by the Board at the <br />continuance of the referenced hearing on January 25, 1996, with the Division staff and <br />with Gwen Fraser, President of COM, Inc. One such matter is whether the Board should <br />set a date for completion of the corrective action in the Cease and Desist Order <br />accompanying Notice of Violation No. M-95-078, COM, Inc. understands that the <br />Division will recommend a completioa date of February 16, 1996, contingent on COM, <br />Inc. waiving certain notice rights. <br />COM, Inc. believes it is unnecessary to set a completion date at the January 25 <br />hearing. COM, Inc. has engaged Colorado Lining Co., a reputable contractor satisfactory <br />to the Division, which is completing the corrective actions as quickly as weather allows. <br />Neither Colorado Lining Co. nor COM, Inc. can project a completion date with certainty, <br />but both are committed to completing the corrective actions to the satisfaction of the <br />Board and the Division as soon as possible. If weather does not permit completion before <br />the Board meeting on February 21.22, 1996, the Board then will have sufficient time to <br />set a completion date before the spring snow melt creates any potential containment risks. <br />~///7-/. //XAtl <br />
