As you know, the Office of the State Engineer is charged with <br />administering SB 120. The regulations require that gravel pits that expose groundwater <br />after December 31, 1980, must put in place a water augmentation plan or substitute <br />supply plan for water that is lost to evaporation from the surface of any water body that is <br />created by the mining activity. <br />I want to divide my response into three parts: <br />A. The lake that has been created at the western end of the permit area. <br />B. The "Chambers Ponds No. 1, 2, 3 and 4" that were cited in the Ruling of the <br />Referee in Application 87CW279. District Court, Water Division No. 5, <br />Colorado. <br />C. Other active mining areas within this Reclamation Permit. <br />A. MMM Lake <br />The first Reclamation Permit (M-1977-120) for this site was issued to Mountain Mobile <br />Mix, Inc. of Frisco, CO (MMM). In 1978 this permit was expanded by MMM to include <br />an area to the east of the existing Reclamation Permit. The MMM application for <br />expanding their existing operation included two aerial photographs that show the pit as it <br />appeared at that time. A 1978 US Department of Agriculture aerial photograph also <br />shows the Mountain Mobile Mix pit at that time. These photographs show that there was <br />a pit in operation in 1978 and show the size and shape of the lake in existence at that time; <br />I do have an aerial photograph that shows the MMM pit near the December 31, 1980 date <br />when SB 120 requirements took effect. This photo was submitted as part of Exhibit G in <br />the Permit Amendment Application for this Permit. The photo was taken on May 3, 1980. <br />
