<br />4 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by Wally Erickson from <br />the DMG Durango office, 484 Turner Drive, Building F, Suite 101, Durango, CO 81301, <br />phone (970) 247-5193. The permit for the Coal Gulch Mine was revoked over 5 years <br />ago. Financial warranty was forfeited and utilized for final reclamation. <br />Mine identification sign was posted at mine entrance. Public access to permit area is <br />controlled by locked cable and fence along Hwy 160. Access road was well <br />maintained. No individuals were contacted, no activities observed during the time of <br />this inspection. <br />Sediment Pond was holding water, water depth visually estimated at 2'. Pond <br />embankment was stable. Spillways were clear of sediment and debris, no discharge <br />from pond. <br />Fire Hawk Contractors are importing soils containing vegetative debris. Vegetative <br />debris is separated and burnt. Stockpiles of vegetative debris were smouldering. <br />Industrial debris was located behind stockpiles of imported topsoil and vegetative <br />debris. Boiler tanks, portions of dismantled vehicles, equipment racks for utility trucks, <br />steel grading, concrete mixing cone, golf club cady, broken window from PU cab, and <br />loading pallets were observed. Area of disturbance, created by Fire Hawk, appeared to <br />have increased significantly. <br />Backfilled and graded areas appeared stable. <br />
