(Page 4) <br />MINE ID # OR PROSPECTING ID #: M-1995-057 <br />INSPECTION DATE: 7128/04 <br />INSPECTOR'S INITIALS~~.- <br />The inspector and the pennitee agreed in principle to the removal of the area within the permit boundaries that is <br />noted as "not to be disturbed" in the northeast corner beyond the noted irrigation ditch. The area appears to be <br />greater than that which will be ultimately disturbed in the removal of the knob in the northwest part. <br />The inspector wishes to note that any or all of the above noted issues could be listed as problems or a violation of <br />the current pemut under applicable rules and state statute. All issues aze viewed by the State as ultimatelybeing the <br />responsibility of the permit holder regazdless of who is actual working within the approved boundaries. This is <br />especially true since there aze two operators working in the same small area. Staff would rather work with the <br />pernlitee to correct the issues in a timely and cooperative manner, rather than an adversarial nature. However, <br />failure to respond to these issues by the noted correction dates will result in the Division changing the issues to more <br />severe categories with appropriate penalties considered. During the submission of the amendment to address <br />disturbance outside the approved permit boundaries the perrnitee should review and address any other concerns with <br />this permit.
