~• i • • <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (9701 247-5469. Operations were active during the time of this <br />inspection. Ross Gubka accompanied the DMG inspector throughout the inspection. <br />Inspection was limited to the active pit area. <br />Signs & Markers -Mine identification sign and safety signs were posted at the mine <br />entrance. Permit boundary markers were observed. Public access is controlled by gate <br />and fence, gate was open. <br />Roads -Mine haul roads and access roads were well maintained. Haul roads were <br />being watered by water truck. <br />Hydrologic Balance -Recent maintenance of clay liner for Pond 007 was complete, <br />pond was refilling, no discharge noted. Pit drainage was being pumped to Pond 007. <br />Pond inlets were rock lined with fabric lining under the rock, inslopes appeared stable, <br />Remaining sediment ponds, treating disturbed area drainage for reclaimed areas, were <br />not inspected. <br />Backfill & Grading -Backfill and grading of active pit was current. Overburden material <br />was being hauled directly to backfill location. Coal haul trucks were being loaded. <br />Drill rig was operating along advancing side of pit, drilling for an overburden shot. <br />Topsoil stripped from advancing side of pit had been winrowed along the reclaimed <br />side of pit. Dozer was redistributing salvaged topsoil over backfilled and graded areas. <br />Rock picker was operating in areas recently topsoiled. Side roll irrigation equipment <br />was present and being prepared for implementation. Reclamation appeared current. <br />
