III. COMMENTS -COMPLIANCE - - <br />Below are comments on the inspection. The comments include discussion of observations made. <br />during the inspection. Comr:~ents also describe airy enforcement.actionstoken during-the inspection.. - . <br />and the facts or evidence supporting the enforcement action. -. - - - <br />This was a partial inspection of the Seneca II-W Mine conducted on Apri124, 2002 by Mike <br />Boulay of the DMG. Robert Shevling of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were clear and cool. Ground conditions were dry throughout the <br />mine site. Auger coal was being hauled from the eastern end of the A pit at the time of the <br />inspection, and the dragline was operating in the South Area pit. <br />Hvdroloeic Balance <br />Site Ponds 005 and 006 were inspected. Sedimentation Pond 005 is now holding water for the <br />first time since it was cleaned out in September of last year. Pond 005 is neazly full but was not <br />dischazging at the time of the inspection. Pond 006 was full and dischazging cleaz water. <br />Vehicle tracks and equipment have damaged the surface of the Pond 006 embankment at the <br />northwest corner of the pond. Please repair the surface damage to at the northwest corner of the <br />embankment, prior to the next inspection. <br />As noted in previous inspection reports, water has been impounded in the 006 Gulch located <br />north of Haul Road C and east of the B Pit pre-settling basin (see reports dated August and <br />September, 2001). The impounded water is located in spoil material from the A Pit. Following <br />the August and September inspections, SCC agreed to remove the water from the impoundment <br />and discharge it to either the B Pit pre-settling basin or Pond 006. Following removal of the <br />water, SCC agreed to commence backfill and grading operations in this immediate area. During <br />this inspection, it was noted that spoil material has been pushed across the 006 Gulch forming a <br />temporary access road and impounding water in the 006 Gulch. <br />To ensure compliance, please continue to remove the water from the impoundment and <br />commence backfill and grading operations at this location. Backfilling and grading the area in <br />accordance with the approved backfill and grading plan will effectively eliminate the <br />impoundment and allow water to drain from the 006 Gulch to the B Pit pre-settling basin or Pond <br />006. <br />Backfill and Gradine <br />A slide occurred in the lower end of the A Pit, on the south side of the pit azea. Spoil material has <br />been pushed across the entire width of the A pit at this location to stabilize the slide. Good <br />progress has been made in backfill and grading the eastern end of the A Pit. <br />
