<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Processino Waste <br />The waste disposal site (including the waste disposal cell and adjacent cover soil and topsoil stockpiles) has <br />been fully reclaimed, with the exception of seeding with the permanent seedmix, to be conducted after October <br />15. Replaced topsoil was extensively roughened and seeded with the "Quickguard" cover crop, which has <br />established well within the track-hoe gouges. No problems were evident; the site appears stable with no <br />appreciable erosion. <br />Topsoil <br />Backfill slopes in the portal bench area and waste disposal area (waste cell and cover soil stockpile area) were <br />properly topsoiled during the June/July 2007 reclamation project. The lower road topsoil stockpile was fully used <br />up, and the stockpile footprint area was graded, roughened and seeded with "Quickguard" cover crop. A small <br />quantity of topsoil remains in the waste disposal stockpile site, to be used for final reclamation of the sediment <br />pond site when the pond is filled in. The remaining soil in stockpile was spread out, roughened and seeded with <br />the cover crop. There is also a small remnant pile of cover soil (subsoil) material in stockpile adjacent to the <br />sediment pond that will be used for final backfilling of the pond. <br />Reveoetation <br />The "Quickguard" cover crop that was seeded in July on areas that were graded and roughened in association <br />with the reclamation project has established and made some growth since the previous inspection. In most <br />areas, the grass has produced vegetative growth 4" to 6" in height. The stand looks promising, but in most <br />areas growth and density is not yet sufficient to provide appreciable soil protection. A few small locations were <br />observed during previous inspections, where it was evident that the cover crop was apparently not seeded, <br />including areas along the outslopes of the portal area lower containment berm, disturbed slopes below the steep <br />segment of the cattle trail, and certain steep outslope locations along the reclaimed road. Operator will need to <br />ensure that these areas are seeded and mulched in association with the permanent seeding later this <br />month. <br />Offsite Support Facilities <br />The Loma Loadout was inspected and the following observation was made: <br />• The SAE silt fence is warn and frayed, and needs to be replaced. <br />Miscellaneous Reclamation Notes <br />• Segments of the old "elephant trunk" culvert outlets are still scattered along the toe of the slope below <br />the reclaimed portal access road, and need to be gathered up and hauled out for proper disposal. <br />• In one location, segments of fiberglass tubing used for an upper road culvert outfall remain on the slope <br />below the backfilled road. The tubing needs to be removed and properly disposed of. <br />• Wooden power poles are stacked along the lower road, west of the Munger Creek culvert, and will need <br />to be hauled out far proper disposal. <br />4 <br />
