Nolan, MD, MPI I <br />Eamnnc Director <br />Dear Mr. Bennett: - / <br />During Jess Vann's inspection of your facility on January 28, 1993, you mentioned that you had <br />no[ received a copy of your renewal permit or new Discharge Monitoring Reports. Upon review <br />of our records, I discovered that we have not received a renewal application or a notice of your <br />intent to reapply. Renewal of your coverage under the general permit was not automatic. <br />Application to renew this permit was required to have been filed with the Water Quality Control <br />Division 180 days prior to the expiration date. Since we did not receive an application from you, <br />your facility's coverage under the permit terminated when the permit expired on September 30, <br />1492. <br />In addition, you are engaged in an activity that is likely included under [he stormwater regulations. <br />We have no record that you have applied for or obtained a stormwater permit for Telluride Gavel, <br />Inc. separately from applying for coverage required for your process water discharges. It is our <br />understanding that stormwater comes into contact with overburden raw material, intermediate <br />products, by products, finished products or waste products located at your site, and is discharged <br />to waters of the State. <br />In 1987, the US Congress amended the Clean Water Act to expressly include stormwater discharges <br />from industrial sites as requiring Clean Water Act controls. in 1990, EPA issued regulations that <br />require specific industrial activities to obtain permits in order to dischazge stormwater from their <br />facilities. Active and inactive sand and gravel mining operations where stormwater comes into <br />contact with overburden, raw material, intermediate products, byproducts, finished products or <br />waste products located a[ the mining site are specifically included. The deadline to apply for a <br />stormwater permit was October 1, 1992. <br />
