(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~ nn <br />INSPECTION DATE: >>-~d-n'~ INSPECTOR'S INITIALS: inn <br />OBSERVATIONS <br />This inspectlon was made in response to a request from Albert Frei and Sons for a partial release (acreaae <br />reducflori) from reclamation responsibllity. Ben Frei accompanied me on the Inspection. The entire permit area <br />was observed. <br />This permit area was last Inspected on March 13.2003. Two problems were noted during that inspection. <br />1. The lake bank slope adlacent to the Fulton Canal )Ditch) was too steep. This item has been corrected in <br />accordance with the inspection report corrective action and is abated. <br />2. There was no evidence of a necessary approved water augmentation plan. This item remains a <br />problem and is due prior to final warranty release, to confirm that it is legal for Albert Fret 8 Sons to <br />.include a lake in the final reclamation. The water augmentation plan is the responsibility of the <br />landowner. <br />About 700 - 800 I. ff. of the lake bank slope adiacent to the Fulton Ditch was observed during the last inspection <br />to have too steep a grade to meet the regulations and permit requirements (problem No. 1). Albert Fret & Sons <br />regarded the slope and it is now satisfactory. The regarded slope has been re-seeded and small crass plants <br />were observed. <br />Mr. Frei stated that he is worklna towards aeffina the landowner to complete their responsibility reaarding a <br />water augmentation plan (problem No. 2). This item must be abated prior to final release from reclamation <br />responsibility. There is no requirement in the permit for an alternative reclamation plan in the event that the <br />landowner does not receive state approval of such a plan. Therefore, the pit must be legally reclaimed to a <br />lake (with approval of the State Engineer's Office -Division of Water Resources). The lake is nearly dry because <br />of drought and around water lowering due to the dewaterina of a nearby gravel pit. However, the dewatered <br />pit is to be lined and dewaterina will stop. When that happens, the M8G Pit will undoubtedly refill with wafer to <br />some level. <br />The release reauesf is for release from further reclamation respons(bilifv for those areas (denf(fled fn the Division's <br />March 13.2003 Inspection report. In particular. the site arading and re-soiling on all but the re-graded area <br />along the Fulton Ditch and the re-vegetation of the area on the request map colored green. The map provided <br />with the request was not colored. However, it is possible to determine from the Inspection and a black and <br />portion of the alt also about 30011near feet are not adeauately re-vegetated. Because these areas are not <br />completely reclaimed, the request for partial release (acreaae reduction) is DENIED. The entire affected area is <br />adeauately graded and topsoiled. The two areas above requested for release but not adeauately re- <br />veaetated and other areas reauirina re-vegetation work total about 5.5 acres. <br />The reclamation plan requires the planting of trees and shrubs. However, there is no requirement for the <br />location or number of established plants. Albert Frei t: Sons have planted many trees and shrubby trees around <br />the perimeter of the lake. If a sufficient portion of these plants show that they are viable this spring, this <br />re~c uirement will be completed. <br />During the inspection. Ben Frei stated that the company only wanted to be released from any further aradlng or <br />topsoilina requirement, and from reclamation responsibility for the area within the permit boundary that is <br />completion of re-vegetation. <br />
