Cottony <br />Acting Division Director <br />Re: Hidden Valley Pit, Permit No. M=1998=024, Financial Warranty Review and Erosion Control. <br />In an effort to ensure the financial warranty remains adequate to reclaim this site per the <br />requirements of the approved reclamation plan, DMG has updated the reclamation cost estimate. <br />Staff calculations estimate the costs to reclaim the Hidden Vallev Pit are sufficiently covered by <br />the current of S83.155.00 bond in place. Current conditions on site have not changed sufficiently <br />from the original estimate for disturbance within Stage A to change any of the original tasks. The <br />update reflects reductions for better equipment efficiency and increases for fuel and seed costs. <br />As part of the Warranty Recalculation, the inspection report from 6/19/02 was reviewed. It is <br />noted that topsoil stockpiles were not protected from erosion as required under Rule 3.1 .9. A <br />correction date of 9/27(02 was noted. To date, this Office has not received documentation that <br />the issue has been addressed. Please supply this Office with documentation that the problem <br />noted was corrected or scheduled for this spring. Failure to correct this issue by April 30th, 2003 <br />may result in the matter being set before the Mined Land Reclamation Board for a formal public <br />hearing. If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, <br />assess a Civil Penalty in the amount of 5100.OG to 51,000.00 for each day of violation, and/or <br />order the permit be suspended, modified, or revoked. <br />If you need additional information, please contact me at the Division of Minerals and Geology, <br />Grand Junction Field Office, 101 S. 3rd St., Suite 301, Grand.
