One of the remaining reclamation liabilities for the <br />Division is the reclamation of the refuse pile located adjacent to <br />the Northfork Landfill. It has been brought to the Division's <br />attention that Delta County is using the gob material as an <br />intermediate layer in the Hotchkiss Landfill. At the request of <br />the Delta County Health Department, the Division will not reclaim <br />the refuse pile due to the current use. <br />The Division is in the process of drafting an agreement between <br />Delta County Health Department and the Division of Minerals and <br />Geology to transfer reclamation liability from the State to the <br />County. This liability transfer would allow the County to continue <br />using the refuse material as an intermediate cover in the landfill, <br />and the relieve the State of reclamation liability. In order to <br />draft this agreement, the Division request that a copy of the <br />Certificate of Designation be sent to the Division. The Division <br />will reference the Certificate of Designation of the Northfork <br />Landfill in the agreement between the County and State regarding <br />the Hawk's Nest Refuse Pile. <br />Please send a copy of the certificate at your convenience.
