III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented <br />the operator during the field inspection or records check. <br />Roads <br />The road up Hubbard Creek was passable. Lower portions of the road were cleaz of snow but a couple <br />of areas were deeply rutted. The upper section of the road was snow packed. The mine site access road <br />over Hubbard Creek was snow packed. The front gate was open. The road leading to pond 5 was snow <br />packed. <br />Siens and Markers <br />The mine ID sign and the records location sign were up on the gate. Surface disturbance markers were <br />up around the disturbed area. <br />Hvdroloey <br />Pond 5 was completely covered in snow. The spillways were functional and the embankment appeared <br />to be stable. The collection ditch leading to pond 5 was also covered in snow but appeazed to have <br />sufficient capacity. Pond 4 was completely covered in snow as well. The pond embankment was stable. <br />The upland diversion ditch at the reclaimed coal stockpile azea was covered in snow. <br />The underdrain pipes at the base of the reclaimed slopes were covered in snow. The two Hubbard <br />Creek culverts were functioning properly. <br />Reclamation <br />The backfilled and graded mine site slopes were mostly covered in snow. There were no indications of <br />slope instability or erosional problems with any of the backfilled slopes. No problems were noted with <br />the benches, reclaimed highwall or with the reclaimed upper road. <br />Records <br />The mine records aze located in the Delta County Clerk and Recorder's Office in Delta. The records <br />were in compliance, as documented in the attached records checklist. <br />c:/word/insp0207a <br />
