<br />MINE ID ~ OR PROSPECTING ID # <br />INSPECTION DATE 10/11/95 <br />(Page 4) ' <br />M-86-061 <br />INSPECTOR'S INITIALS ACS <br />There were several puddles of water outby of the portal, and channel development that clearly <br />indicates that the portal periodically discharges water into an adjacent ephemeral stream <br />that ie tributary to Fourmile Canyon Creek. Mr. Conner stated that the Phil Sheridan Tunnel <br />was discharging during the spring of 1995. Since it ie the operators goal and intention to <br />connect with. and to mine an historic tunnel that exhibits sporadic discharge to waters of <br />the State, .it is imperative that the Water Quality Control Division of the Colorado <br />Department o:f Public Health and Environment be contacted, and a CDPS Permit secured. The <br />operator must characterize baseline water quality at the Phil Sheridan Tunnel through <br />collection and analysis of water samples before the shaft currently being sunk connects with <br />the tunnel. The operator ie strongly advised to contact the Water Quality Control Division, <br />determine what is required, and obtain a CDPS Permit rior to connecting with the Phil <br />Sheridan Tunnel. Failure to do so could result in enforcement actions, civil penalties, and <br />the potential for perpetual liability for the water quality of effluents from the Phil <br />Sheridan Tunnel. Any questions regarding the CDPS permitting process should be directed to <br />the Water Quality Control Division. <br />The results of any water quality analyses from the Phil Sheridan Tunnel must be copied to <br />this Division, in order to aid in any assessment of the potential for groundwater impacts. <br />Given that the current operations are above the water table, and are being conducted in <br />unaltered, chemically inert rock, the Division stands by its 1988 finding that impacts to <br />groundwater quality caused by this operation are unlikely. <br />During this inspection, Mr. Conner asked what the regulatory and permitting aspects of <br />exporting the waste/development rock from the site would be. He indicated that the rock <br />could be marketed for a number of beneficial off-site uses, including general and structural <br />fill at home-sites in the area. Exportation of unaltered, chemically inert waste/development <br />rock for off-•site beneficial uses is consistent with the terms of the Phil Sheridan Lode <br />Reclamation I?ermit. Altered waste rock, vein material, or rock with visible sulphide <br />mineralization must be disposed of on-site in accordance with the approved waste rock <br />disposal plan. <br />Referencee• <br />1.
