ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_t 9a~_nste <br />INSPECTION DATE: 5/1L/n~ INSPECTORDS INITIALS: ~_ <br />OBSERVATION <br />The Division conducted a monitoring inspection of the site to determine if the operator had conducted <br />additional reclamation work to lower the financial warranty. Mr. John Miner is subletting the site from Douglas <br />County Sand and Gravel, and wanted to see if he can lower the existing warranty of $98,189.00. The site is <br />allowed to affect up to 57.5 acres of the total 66.50 acres. At present approximately 23 acres is disturbed in one <br />form or another. The Division has been working with Mr. Miner to allow him to do reclamation work to lower the <br />financial liability for the site so he can succeed the operation. <br />In addition the Division had requested the operator to remove a lot of the none mine waste and mining related <br />equipment chat is not utilized on site but is for sale, in one form or another, to be moved from the permit area to <br />lower the liability. Operator had agreed to actively remove items and conduct reclamation activities. <br />During the inspection on 5/1 /06, no additional reclamation activates had been conducted. In fact a portion of <br />the area that was sloped and graded during the last inspection appeared to have been disturbed. A lot of <br />none mine and mining related equipment was still scattered through out the permit area. There was also a <br />trailer that is being used as housing on site. Mr. Miner said, it was being used to house a guard to protect the <br />property at night. Site was active at the time of the inspection. <br />Mr. Miner agreed to do the required clean up by placing all the none mine waste in one area closer to the <br />access gate, in an area already disturbed and conduct additional recalamtion work along the North and East <br />side of the permit. He requested a site visit with in two weeks. The Division had worked to assist Mr. Miner to <br />lower his liability for some time. It appears that due to the nature of the business, he has been unable fo <br />accomplish the task. At this time the Division cannot reduce the warranty. In fact if all the none mine waste is <br />not removed or placed in a concentrated area, additional warranty might be needed to remove the large <br />quantify of none mine related waste and equipment on site. Granted with the price of metals as high as they <br />are, one can envision some one removing it for salvage value, however, since DMG is not into the salvage <br />business, we have to assume all the items to be Scarp, and removed from site at cost. <br />18.
