III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was an aerial inspection of the King Coal Mine flown by Harry Ranney on August 18, 2004. Tom <br />Kaldenbach examined digital images on a computer monitor two days later. <br />Seven photos were taken during the flyover; two representative photos are shown below, The ground <br />appeared dry. The site appears as it has in recent on-ground inspections. No compliance problems are <br />evident in the photos. <br />Processing Waste <br />The waste pile showed no evidence of instability. The top of the pile appeared dry. The face of the <br />waste pile did not appear excessively gullied. Diversion ditches extending from the top of the pile <br />appeared in good condition. <br />General Mine Plan Compliance <br />Ground surface disturbance appears to be confined to approved areas. <br />Air Resource Protection <br />No dust problems were evident in the photos. <br />
