III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />There was only a little water in West Buzzard No. 1, East Pyeatt <br />No. 1, Grouse Nos. 1 and 2, and the Deer pond. There was no water <br />in East Buzzard Nos. 1 and 2, Far East Buzzard No. 1, Middle Pyeatt <br />Nos. 2 and 3, Sage Nos. 1 and 2, and Oak Nos. 1 and 2. <br />The operator is still constructing the Oak No. 1 pond and the <br />spillway of the Oak No. 2 pond. According to the operator, the two <br />ponds should be completed and certified within one to two weeks. <br />All of the embankments of all of the ponds appeared to be stable. <br />Spillways were functional. The operator stated that sediment will <br />be cleaned out of ponds West Pyeatt No. 1, East Pyeatt No. 1 and <br />Grouse No. 1. Work is supposed to take place the week of June 24. <br />The inlet to the Deer pond is starting to down cut. The gully will <br />need to be filled in and watched to see if more durable material <br />may be needed to stop the erosion. There were no problems at <br />impoundment H and the industrial waste pond. <br />PIT AREAS <br />There was no activity in the Enfield pit. At the Derringer pit, the <br />dragline Molly Brown is moving down gradient on the east side of <br />the pit. The uncovered coal seam has been blasted and is ready for <br />hauling. The operator is ready for blasting ahead of the dragline. <br />The spoil piles behind the Derringer .pit have been graded. At the <br />Ashmore pit, the dragline Queen Anne was down for maintenance. <br />Terraces had been cut for drilling, in advance of the pit. <br />Topsoiling activities were in progress behind the Ashmore pit. <br />Brush was being cleared on the east side of the haul road, opposite <br />the present location of the Ashmore pit, for future mining. The <br />area is in the Sage drainage. There was no mining going on at the <br />Hawkin pit. No problems were observed at the ash pit. <br />RECLAMATION <br />There were no major gullies observed in any of the reclaimed areas. <br />Rock check dams appeared to be functional. The vegetation has been <br />a little late in coming up. There were several areas around the <br />mine site where noxious weeds were present. The operator will be <br />busy this year with weed eradication. <br />At the slide area in the Scraper pit south of the ash pit, there <br />was a trickle of water coming out of the french drain. The contour <br />diversion ditches were functional. The operator had planted fifty <br />3 <br />
