PUBLIC NOTICE <br />The Colorado Division of Minerals and Geology proposes to reduce the inspection <br />frequency of the Hawk's Nest Mine (Permit No. C-1981-016) from a minimum of 12 <br />inspections per year to one complete and three partial inspections per year. <br />The Hawk's Nest Mine is a revoked forfeited coal mine located in Gunnison County, <br />approximately 3 miles east of the town of Somerset, CO. The permit was held by <br />Western Slope Cazbon, Inc. The approximate legal description of the mine site is <br />portions of sections 1, 2, 3, 10, 11, and 12 of T13S, R90W. The total permit acreage <br />encompasses 2050 acres, with approximately 29 acres disturbed. <br />The site has been reclaimed since 1995 with some additional reclamation work since that <br />time. Of the original $624,803.05 of forfeited bond monies, $183.13 remains. <br />The Division is proposing to reduce the inspection frequency because the site has been <br />lazgety reclaimed and poses no imminent threats to public health and safety or significant <br />environmental hazm to land, air or water resources. Site conditions generally change <br />very little from month to month. The Division proposes one complete and three partial <br />inspections each year, conducted quarterly. This inspection frequency will be sufficient <br />to monitor success of vegetation establishment, weed control, and to identify developing <br />problems which may require maintenance. <br />This decision is based on a complete inspection and a written finding as required by Rule <br />5.02.2(8)(a) of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, <br />et seq., C.R.S., and the regulations promulgated thereunder. Copies of the written <br />findings are on file for public inspection at the Colorado Division of Minerals and <br />Geology, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado, <br />80203, telephone (303) 866-3567; at the Gunnison County Clerk and Recorder's Office <br />at 200 East V irginia, Gunnison, Colorado; and at the Delta County Clerk and Recorder, <br />501 Palmer, Delta, Colorado. Persons with any interest that may be adversely affected by <br />the proposed reduced inspection frequency may submit written comments to the <br />Colorado Division of Minerals and Geology, within thirty (30) days of this notice. <br />
