III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash and Sandy Brown of the DRMS. No one represented the <br />operator during the inspection. There was no activity on site. <br />Roads <br />The Hubbard Creek road had been recently graded and was in good condition. The mine site entry road over <br />Hubbard Creek was also in good condition, as was the light use road to pond 5. The front gate was closed and <br />locked. <br />Siens and Markers <br />The mine Id sign and the records location sign were attached to the front gate. Surface disturbance markers were <br />present around the disturbed area. <br />Hydrology <br />Pond 4 was completely dry. Pond 4 spillways were operational and the pond embankment was well vegetated <br />The road culvert that brings surface runoff from the reclaimed coal stockpile area to pond 4 was clear. The <br />upland diversion ditch behind the reclaimed coal stockpile area was well grassed and had sufficient capacity. <br />Pond 5 was also dry. The primary and emergency spillways were functional. The collection ditch that leads into <br />the north end of pond 5 had sufficient capacity and was well vegetated. <br />There was a very slow but steady drip of water coming out of the north underdrain, while the two other <br />underdrains were completely dry. The black culvert that brings water from the upper reclaimed terrace down to <br />the pond 5 collection ditch was in place and was operational. <br />Reclamation <br />The backfilled and graded mine site slopes were well vegetated and appeared to be stable. The backfilled <br />highwall also appeared to be stable. There were no signs of erosional problems, nor were there any indications <br />of slope instability. There was no standing water on the reclaimed tercaces. <br />The Russian knapweed patch immediately north of pond 4 needs to be sprayed. <br />c:/word/bowie2/insp0907 <br />
