III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />• diversion ditch ("K") is in place above the remnant cover soil stockpile (to be used for sediment pond <br />backfill), but the ditch configuration differs from that depicted on Permit Figure 2.2-6. This modification <br />will need to be addressed in the technical revision "As-Built". <br />• Sediment pond remained dry. <br />• Perimeter livestock fencing yet to be installed. <br />Miscellaneous <br />• Disturbed area perimeter in many locations appear to have been knocked down or lost over the years or <br />during the reclamation project, and markers need to be replaced to clearly delineate the disturbed areas <br />for the remainder of the liability period. Replacement of the markers in the portal bench and upper road <br />areas will be difficult due to lack of access following completion of the upper road reclamation work and <br />channel construction. Presently, these areas could still be accessed by ATV. <br />5 <br />
