III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. BiII Bear represented the <br />operator. The operator has done a lot of maintenance work at the mine since the last inspection. <br />Main Mine Site <br />On the utility bench, the back ditch was cleaned. The bench's outside berm was functional. Some mine <br />equipment had been recently moved out. The road up to the utility bench was dry and passable. A road Swale <br />had been constructed across the road for better drainage control. <br />There was only a small amount of coal that had been stockpiled on the D-seam portal bench. The facilities were <br />in order and there were no fuel leaks at the fuel barn. The portal bench outside berm was in place. Some ditches <br />and culverts had recently been maintained on this bench. The main topsoil stockpile was well vegetated but the <br />vegetation is starting to turn brown due to the lack of precipitation. <br />Ditches have been cleaned and culverts maintained at the mine entrance and neaz the wash plant. Straw bales <br />and silt fence have been replaced at the mine entrance small area exemptions and at the mine entrance area. <br />There was very little water in pond B. <br />The gob pile haul road was in very good condition. The road ditch had been recently cleaned and the road berm <br />was in place. The roads were being watered during the inspection. There was recent ditch and culvert <br />maintenance around the pond C and pond D areas. There was only a little water in pond C and pond D was dry. <br />Mine ID signs were up at the entrance and along the main road. Surface disturbance markers were up around the <br />site. Cut and fill slopes for the benches were stable. <br />Hubbard Creek Geotech Drill Site <br />Bowie is planning on constructing a vent shaft at this site along Hubbazd Creek. The geotech drilling is finished. <br />There was no activity at this site. The silt fence and straw bales were in place. The topsoil stockpile was <br />protected with silt fence. The topsoil sign was up. Mine ID signs were up, as were stream buffer zone signs. One <br />mine ID sign was off of its post. The drill pad entrance was fenced off. <br />Unit Train Loadout <br />There had been recent ditch maintenance at the loadout. Pond J and pond K were dry. Pond embankments were <br />stable. A loaded train was on site but there were no indications of fugitive dust. Surface disturbance markers <br />were up. <br />c:/word bow ie2/insp0707 <br />
