R <br /> <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Arness McGriffen Mine was conducted by DMG staff from the <br />Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247- <br />5469. The permit for the Arness McGriffen Mine was revoked over 5 years ago. Financial <br />warranty was forteited and utilized for final reclamation. No activities were observed, no <br />personnel encountered during the time of this inspection. Soil conditions were wet due to <br />recent precipitation and snow melt. <br />The mine access road remains open to provide access to state lands, located north of the <br />permit area. Public access to the site and adjacent state lands is controlled by locked cable <br />closure. The cable was locked. A sign at the gate indicates that public access will be <br />restricted from mid November through mid March, by the Colorado Division of Wildlife. <br />Portions of the reclaimed area have been adversely impacted by off-road traffic. <br />Reclamation efforts may benefit from the controlled access. <br />Approximately 376' of guard rail had been constructed along an exposed portion of the <br />access road. The guard rail had been constructed with 6" x 6" pressure treated timbers and <br />approximate 1" diameter steel cable. Labels on the timbers stated 6" x 6" x 12', Chromated <br />Copper Arsenate. The timbers had been sunk into the ground at approximate 8' intervals <br />and drilled to accept the 1" diameter cable. Depth of burial was not determined, but <br />approximately 3' of the post extended above the ground surface. Fresh concrete splash was <br />observed on several of the posts. The timbers appeared to have been set in a "post mix" <br />type concrete product. The cable was spliced at one location with 4 cable clamps (U-bolts). <br />The two ends of the cable extended underground. Depth to the cable anchor and nature of <br />the cable anchors was not determined. A total of 47 posts were counted (47 posts x 8' <br />spacing = 376' total length). <br />
