Box 37 <br />Salida, Colorado 81201 <br />Phone 719-539-2222 <br />February 6, 2007 <br />,~ Division of Reclamation, Mining, and Safety <br />Attn: Kate Pickford <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />RE: Chaparral Meadows Pit <br />Dear Ms. Pickford, <br />~~ ~~ <br />n~ - i9~~- /o/ <br />RECEIVED <br />FEB 0 8 2001 <br />Division o; Reclamation, <br />Mining and Safety <br />First of all I would like to apologize for not responding to the original letter, I thought we had, so <br />again, I am very sorry. <br />Problem number 1, which stated that the vegetative cover was insufficient, we agree, and we are <br />going to reseed the piles once the weather allows, and we will meet the May 30, 2007, deadline. <br />Problem number 2, the storage tank located at the site, is a water tank, and therefore does not <br />require spill containment. We have left the tank for future work at this site, rather than remove <br />the tank, and have to replace it each time we go to work there. We can mark the tank, to show <br />that it holds water, rather than a hydrocarbon. Please advise to the marking of the tank. We do <br />not have a SPCC plan for the site; we have the SPCC plan for the equipment, which moves to the <br />site when needed. All of our equipment has an SPCC plan and when setup at a site, all spill <br />containment is in place. <br />Problem number 3, the recycled asphalt is not intended for backfill at this time, we use recycled <br />asphalt in the mixture of new asphalt. The site is active, and not subject to complete reclamation, <br />we intend to move the asphalt, or reuse it in the production of asphalt. We do not understand why <br />we must remove the asphalt, due to the site being permitted and bonded. Please advise. <br />Problem number 4, we will remove the 55-gallon drum from the site. I have spoken to our staff, <br />and we will have it removed. <br />Once the seeding is complete we will call for a follow up inspection to the site. I hope this meets <br />with your satisfaction.
