Banta. <br />Division Director <br />RE: MLRD Inspection Report; C & J Gravel, Montoya Pit; Permit No. M-80-146 <br />Dear Mr. Gilliland: <br />Last week, the Division sent you a copy of our 1/10/92 inspection report for <br />the above cited operation. We had a few comments that, for lack of time, we <br />were unable to give you when the report was mailed. I will cover those in <br />this letter. You should regard this letter as an amendment to the above cited <br />inspection report. <br />In the coming months, the Division will be evaluating the bond that is <br />currently held for this property. We will of course calculate the Division's <br />costs for reclaiming the operation according to the approved mining plan. At <br />that time, we will be back in touch with you if problems arise. <br />Meanwhile, your current permit file has pending the Amendment tl2 which <br />proposed to add 4 acres to the east side of your permit boundary. This <br />amendment is pending because the Division has not received the bond for this <br />particular parcel of land. The amendment was approved automatically on April <br />20, 1991. Rule 7.5(7) states that if financial warranty has not been received <br />within one year, the Board will hold a hearing to reconsider the previous <br />approval. Therefore, it is imperative that we receive your bond by at least <br />April 20, 1992. <br />The above-cited 4 acre tract is currently bounded on the west by a vertical <br />highwall. Because your permit states that you will reclaim to a 3:1 slope, <br />and because there appears not be be enough material in the area currently <br />leased to reclaim to that slope, the Division is concerned that your operation <br />may not be in compliance. This is of particular concern in light of the fact <br />that we have not received financial warranty assurance for the Amendment 2 <br />area. <br />Because of these concerns, the Division will re-inspect your site in the near <br />future. We recommend that you evaluate your total mining situation, clear up <br />problems with the bond for the Amendment Jt2 area, measure the west high walls <br />to determine whether you have material on site to reclaim to 3:1, and send us <br />that information as soon as possible. <br />
