III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments Include discusslon.of observations.made <br />during the inspection: Comments also describe any enforcement actions taken during the Inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection that was flown on August 10, 2004. On August 17, 2004, the digital <br />images from the overflight were reviewed. There were no reports of compliance problems at the mine <br />site during the overflight. <br />Roads <br />The paved main haul road was in very good condition. The east half of the graveled haul road to gob <br />pile no. 1 was wet but the entire road length was passable. The dirt access road up to the water tank _ <br />bench appeazed to be dry and in good condition. The road to gob pile no. 2 was wet but passable. <br />Hydrology , <br />There was a moderate volume of water in ponds B, C, D and F. Ponds J and K were dry. Pond <br />embankments and pond inslopes appeazed to be stable. <br />Topsoil Stockpiles <br />The operator has spread mulch blankets on the north-facing side of the main topsoil stockpile where <br />recently salvaged topsoil had been placed. <br />Coal Waste Stockpiles <br />At gob pile no. 1, coal waste has been placed on the fourth level. The lower three levels have their <br />outslopes covered with soil material. The upland diversion ditch appeazed to be functional. The upland <br />diversion ditch has been constructed at gob pile no. 2 and appeazs to be functional. Coal waste was <br />being placed on gob pile no. 2 at the time of the inspection. There did not appeaz to be any ponded <br />water on top of either pile. <br />Slone Stability <br />There were no indications of slope instability with any of the cut and fill slopes. There were no lazge <br />rocks in the rock catchment berm above the water tank bench. The berm itself appeazs to be stable. <br />However, the operator has yet to cover the south-facing black fabric of the berm. <br />Facilities <br />The operator continues to work on the prep plant. The outer shell of the plant still needs to be put up. <br />There was only a fair amount of coal at the coal stockpile along the highway while the coal stockpile <br />on the D seam portal bench was quite lazge. There were no problems with any of the facilities on the D <br />seam and B seam portal benches. There was one very small seep on the cut slope above the B seam <br />portal bench.
