(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~vf-~QZZ-~~~ <br />INSPECTION DATE: ~-~ z-n5 INSPECTORS INITIALS: Inn <br />OBSERVATIONS <br />This inspection was made to monitor the operator's compliance with the permit and regulations. Mark Welte <br />represented Summit Brick and Tile Company and accompanied the inspectors. <br />The permit area is in two parts and totals 9.9 acres. The east portion is approximately 7 acres, of which 4-5 acres <br />hay~been mined out The wPSt ortion is cPDarn#ad from the aaSt partinn by n~ctri^n of Innri nnn~rrnvimateLy 1QQ _ _ _ <br />feet wide. The west part has not been mined under the permit, but if does include some areas of pre-law <br />mining. <br />The aCfive pit area (east porfion) slopes to the west and has highwalls on fhe south, east and north sides. The <br />west side of the pit daylights; however, the pit floor is lower and there is no positive drainage from the pit. There <br />is not a significant watershed contributing overland flow to the pit. <br />A city street runs north and south nearly parallel to and very close to the top of the east highwall, which is <br />approximately 25 to 35 feet high and very steep (approximately O.Sh : 1 v). A chain link fence protects the <br />public from any danger posed by the highwall. There is no evidence that the highwall is unstable, at this time. <br />It consists mostly of unexcavated clay resource, There is some minor erosion on the highwall slope. If the <br />highwall should become unstable or erode severely, the city street and other property outside the permit area <br />could be damaged. <br />The reclamation plan includes backfilling the pit highwall with discarded brick, factory materials and processing <br />waste material. It appeared that Summit Brick & Tile has These types of materials neor by in p waste yard. The <br />stated purpose of the backfill in the permit is "to stabilize the highwall and prevent slumping, sliding or <br />subsidence of the surface adjacent to the top of the highwall," which is where the city street is. The operator <br />must backfill that portion of the east highwall not needed for clay extraction to near reclamation grade, or <br />submit a slope stability analysis completed by a professional engineer that demonstrates that the highwall will <br />not fail to the point that it will negatively impact property outside the permit boundary. <br />Summit Brick & Tile has not scarfed reclamation work in the permit area. The reclamation bond held by the <br />Division is $6,500.00. The bond is very likely not adequate considering the reclamation plan requirement to <br />backfill the highwall with waste materials that must be hauled some distance from factory waste piles. <br />Mr. Joseph Welte was contacted, on February 28, 2005 by phone, regarding the inspector's concerns about <br />the potential for off site damage (city street) and the adequacy of the bond. He said that he had not seen the <br />pit for 20 years and offered to look the situation over and call back. Mr. Welte's consultant Joe Gagliano of L J <br />Development called back on February 29~h and reported that he estimated the highwall to be 25 - 30 feet high <br />and that Summit Brick and Tile has a waste brick stockpile about 400 feet away that has enough material in it to <br />backfill the present east highwall, which is about 150 feet long.
