• (Page 3) • <br />MINE ID # OR PROSPECTING ID # M-80-131 <br />INSPECTION DATE 8/28/97 INSPECTOR'S INITIALS ACS <br />Deakins' pastures was inspected. This structure was installed to protect the adjacent <br />railroad embankment. This structure may increase flood depths along the Ana Branch in <br />upstream areas. <br />Review of the Bunn Ranch Pit permit file and of Flood Insurance Rate Maps (FIRM) for the <br />surrounding area produced the following findings and conclusions. <br />1. The Deakins' east and west pastures south of the railroad are in the flood plain. The <br />pastures and the Bunn Ranch permit area are shown in zone A3 on Moffat County FIRM panels 768 <br />and 766. The effective date for the FIRM's is August 2, 1982, approximately 2 years after <br />the issuance of the Bunn Ranch Pit permit. <br />2. The terms of the Bunn Ranch Pit permit allow the operator to erect flood protection berms <br />around the property. The following excerpts are from Exhibit D to the approved permit: <br />Overburden will be used to build a combination haul road and flood <br />protection berm around the perimeter of the affected area... <br />The flood protection berm and haul road will also protect stockpiled <br />topsoil as well as the pit area from flooding. <br />Construction of berms to protect the office and stockpile areas is acceptable under the terms <br />of the approved permit. However, construction of berms in the flood plain may be subject to <br />separate local regulation. <br />Since erection of berms around the affected area is approved in the permit, and since the <br />placement of these berms does not increase the size of the flood plain, and since the berms <br />are needed to protect stockpiles and facilities, the Division has no cause to restrict the <br />operator from building or maintaining the berms. <br />cc: Carl Mount, DMG <br />Robert Deakins <br />P.O.
