III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Include discussion of observations <br />mode during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection of the Terror Creek Loadout conducted by Susan <br />Burgmaier from DMG. Harry Ranney took the aerial photos on June 13, 2006. <br />Weather was clear and the ground was dry. <br />Railcars were being loaded and others were sitting on the siding. A truck was <br />dumping coal at the stockpile area, and several trucks were parked adjacent to the <br />stockpile area. The sediment pond appeared to be dry. There appeared to be a <br />large amount of coal spilled around the railcar loading area, and some coal had <br />been deposited on the outslope of the stockpile area along the conveyor to the <br />railcar loading chute. DMG will follow up on this during the next ground inspection of <br />the site. No other problems were observed. <br />
