(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1985-129 <br />INSPECTION DATE 06/06/2007 <br />INSPECTOR'S INITIALS DEZ <br />This inspection of Permit Number M-1985-129 (Elbert County Pit) was conducted by Deb E. Zack of the DRMS as part of the <br />routine monitoring and inspection protocol. Mary Sue Liss of the Elbert County Public Health Dept, Rick Manyik of Elbert <br />County Road and Bridge, and Dan Ardrey of M&M Land Company were present during this inspection. The pit is located one <br />mile north of Elbert, CO at the junction of County Roads 25-41 and 102, and currently consists of approximately 100 acres, of <br />which approximately 15 are currently disturbed. <br />The Division expects to receive a request to release a section of this pit that has been disturbed - a flattened pad area and a <br />portion of the haul/access road. On June 14, 2007 the Division received a letter (enclosed) from the landowner requesting that <br />both the flattened pad area to the east of the access road and road itself be left in place in their current condition, for his <br />personal use. <br />During the inspection performed on June 6, 2007, this portion of the site was flagged and documented. This inspector also <br />requested a revised map illustrating the revised permit boundaries, and active/disturbed portions of the site. In addition, a large <br />portion of the 100-acre site appears to have not been disturbed at all, and a substantial portion of the previously disturbed area <br />has been successfully reclaimed tc state standards. Therefore, it is the determination of this inspector that, at least, the pad <br />area and portion of the haul/access road can be released to the landowner for an alternate use. Notice of this determination will <br />be sent under separate cover once a formal and complete release request is submitted. <br />Mine entrance sign and permit boundary markers were all in place. All activities and completed work at the time of inspection <br />appeared to follow the guidelines and regulations set forth by the state and the approved mining and reclamation plans for the <br />pit, and no problems are noted for this site. <br />The site is stable, and no disturbance was observed outside of the approved permit boundaries. <br />Responses to this inspection report should be directed to Deb E.
